Certain functionalities or apps that are part of the GoodVybs service may also provide you with contextual privacy information or choices, in addition to the information and choices described in this Privacy Statement. Section A: Our Collection, Use, and Disclosure of Personal Information

The Categories of Personal Information We Collect
We collect the following categories of personal information about you:

Personal details: When you register with the GoodVybs service, we collect your contact information (such as your email address) and authentication information for your login (such as a password). Depending on your interaction with the GoodVybs service, we also collect one or more of the following: first and last name, phone number, postal address, gender, date of birth, and other identifiers you provide to us.
Payment details: We collect your Payment Method (as defined in the GoodVybs Terms of Use), and other information to process your payments (such as when you subscribe to the GoodVybs service), including your payment history, billing address, and gift cards and Offers (as defined in the GoodVybs Terms of Use) you have redeemed.
Purchase information: We collect purchase information such as information you provide when you make a purchase with GoodVybs, your purchase history and other products purchased or considered (such as those in your shopping cart), and overall purchase habits.
GoodVybs account/profile information: We collect information that is associated with your GoodVybs account and/or GoodVybs profiles on your account (such as profile name and icon, GoodVybs game handle, ratings and feedback you provide for GoodVybs content), “My List” (watch list of titles), “continue watching” information, account/profile settings, and choices in connection with your use of the GoodVybs service.
Usage information: We collect information about your interaction with the GoodVybs service (including playback events, such as play, pause, etc.); choices made when engaging with interactive titles, your GoodVybs game activity (such as gameplay, game use and interaction information, and progress or saved game information); GoodVybs viewing and gaming history; search queries on the GoodVybs service; voice inputs (including transcripts and recordings) when using voice-related features; and other information about your use and interaction with the GoodVybs service (such as app clicks, text input, page views, time and duration of access, and camera/photo access for QR-code functionality and GoodVybs games features).
Advertising information: We collect information about the advertisements on the GoodVybs service that you view or interact with, device information (such as resettable device identifiers), IP addresses, inferences we make about you or your household based on data we collect from or about you (such as the types of ads you or your household prefer to see), and information provided by Advertising Companies (such as your demographic information, likely interests they have collected or inferred from your interactions and purchases through their own and other websites and apps). We also collect information on Advertiser websites and apps. We use this information to support advertisements (including behavioral advertisements in accordance with your preferences. “Behavioral Advertisements” are those that are selected based on information about your use and/or interactions with unaffiliated third party services).
Device and network information: We collect information about your computer or other GoodVybs supported devices you might use to access our service (such as smart TVs, mobile devices, set top boxes, gaming systems, and other streaming media devices), your network, and network devices. The information includes:
device IDs or other unique identifiers, including for your network devices, and devices that are GoodVybs supported on your network;
IP addresses (which can be used to tell us the general location of your device, such as your city, state/province, and postal code);
device and software characteristics (such as type and configuration), referring source (for example, referrer URLs), standard web browser and mobile app log information, and connection information including type (such as wifi or cellular);
performance data such as crash reports, timestamps, and debug log messages; and
cookie data, resettable device identifiers, advertising identifiers and other unique identifiers (described below in the section “Cookies and other Technologies”).
Communications: If you communicate with GoodVybs (such as contacting customer support via online chat or voice call), or engage in our surveys or feedback requests (such as when you cancel), we collect the contents of such communications. We also collect details of communications that we send you (such as via email, push notifications, text message, or within the GoodVybs service), and information about your interaction with these communications.
Where We Collect Personal Information From
We collect your personal information from the following sources:

Directly from you: When you register with the GoodVybs service, update your GoodVybs account or profile, purchase products or services from us, correspond with us, or respond to our surveys, you may provide (and we will collect) the following categories of personal information: personal details, payment details, purchase information, GoodVybs account/profile information, and communications.
Automatically when you use our service: We automatically collect the following categories of personal information in connection with your use of the GoodVybs service: GoodVybs account/profile information, purchase information, usage information, advertising information, device and network information, and communications.
From Partners whose products and services you use: We may collect the following categories of personal information about you from third parties whose services you use to access, pay for, or interact with the GoodVybs service (“Partners”): personal details, payment details, usage information, and device and network information. The categories of personal information that Partners provide to us will vary depending on the nature of the Partner and your relationship with them. Our Partners may include your TV manufacturer, internet service provider, streaming media device provider, mobile phone carriers, or other companies who collect payment for the GoodVybs service. For example, Partners may provide us:
personal details (such as your email address), device and network information (such as IP addresses, device IDs, or other unique identifiers), or other personal information in order to activate the GoodVybs service, or present GoodVybs content to you through portions of the Partner’s user interface;
payment details (such as associated pre-paid promotions and billing information) if they are assisting with billing or collecting payment for the GoodVybs service; and
search queries and commands applicable to GoodVybs that you make through Partner devices, platforms, or voice assistance platforms.
From other sources: We may collect the following categories of personal information about you from other sources: personal details, payment details, and device and network information. These sources include:
Service Providers such as vendors, agents, and contractors that collect or provide personal information to GoodVybs in connection with services they perform on our behalf (“Service Providers”). This may include Service Providers such as those that:
help us determine a general geographic location based on your IP address in order to customize our service and for other uses consistent with this Privacy Statement;
provide us with information to secure our systems, prevent fraud, and help us protect the security of GoodVybs and our users;
provide us with payment processing services including payment or balance information, or updates to that information; and
provide GoodVybs games, or portions or features of those games, as part of the GoodVybs service (for example, some GoodVybs games are licensed from and run by Service Providers).
GoodVybs Marketing Providers when you interact with marketing campaigns promoting the GoodVybs service or GoodVybs content (such as our ads on third party services). Please see the “Cookies and other Technologies” section below for details.
Third-party sites and forums where we provide support for the GoodVybs service (such as an online support forum for GoodVybs customer support or for a particular GoodVybs game).
Publicly available sources such as public posts on social media platforms (for example, where you have tagged GoodVybs in a publicly-available social media post, or shared or liked content we have made available on social media) and other information available through public databases, in accordance with applicable laws.
Advertising Companies: We may collect advertising information about you from other sources to support advertisements, including the following (collectively referred to as “Advertising Companies”):
Advertisers that run advertisements on GoodVybs (“Advertisers”) may provide us with or allow us to collect unique identifiers (for example, cookies or resettable device identifiers), and demographic information and other information (such as information about the interactions and purchases on their websites and apps and likely interests they have collected or inferred based on their visitors’ activities online) to deliver and support advertisements;
service providers that facilitate the sale, operations, and management of advertisements (“Ad Service Providers”);
ad measurement companies that support GoodVybsand Advertisers in understanding the effectiveness of advertisements (“Ad Measurement Companies”); and
online and offline information providers to support advertisements (for example, they may provide us your general location information based on your device’s IP address, such as city, state, and postal code, supplement information we may have about you with demographic data, or provide us information about your likely interests they have collected or inferred based on your activities online).
How We Use Your Personal Information
We use your personal information to provide, maintain, improve, and promote the GoodVybs service, and to communicate with you. This involves using the categories of personal information listed above for the following purposes:

To provide our service including making personalized recommendations for GoodVybs content that we think will be of interest to you. This may also include personalizing and optimizing the features and functionalities of the service (such as the way in which the recommendations are presented to you), and localizing GoodVybs content relevant to your geography in compliance with our content partners’ licensing terms. We use the following categories of personal information for this purpose: personal details, GoodVybs account/profile information, purchase information, usage information, device and network information, and communications.
To administer and operate our business including purposes such as processing payments and any gift cards you redeem, sending transactional communications to you (such as confirmation of subscription start date or information about changes to your account), determining your internet service provider to support network troubleshooting issues, responding to your inquiries and requests, and assisting you with operational requests such as password resets. We use the following categories of personal information for this purpose: personal details, payment details, purchase information, GoodVybs account/profile information, usage information, device and network information, and communications.
To research, analyze, and improve our services such as analyzing and understanding how users interact with the GoodVybs service, to improve our services and optimize GoodVybs content selection and service delivery. This may also include processing your personal information in connection with any surveys you participate in. We use the following categories of personal information for this purpose: personal details, payment details, purchase information, GoodVybs account/profile information, usage information, device and network information, and communications.
To enable Partner integrations and promotions so that our Partners can promote the GoodVybs service and make it available to you through Partner devices and integrations, based on the specific relationship you have with the Partner. We use the following categories of personal information for this purpose: personal details, payment details, GoodVybs account/profile information, usage information, device and network information, and communications.
To send marketing and informational messages including news and promotional communications about our service, new features, available GoodVybs content, Offers, as well as GoodVybs marketing on third party services. Any of these messages, including GoodVybs marketing on third party services, may or may not be personalized for you or your likely interests. Please see the section “Communication Preferences” below to change your communications preferences. To understand your choices in connection with GoodVybs’ marketing on third party services, please see the “Cookies and other Technologies” section below. Depending on the nature of the message we send, we may use the following categories of personal information for this purpose: personal details, payment details, GoodVybs account/profile information, purchase information, usage information, device and network information, and communications.
To support advertisements including to provide, analyze, administer, enhance, optimize, select, deliver and measure advertisements. We use the following categories of personal information for this purpose: personal details, payment details, purchase information, GoodVybs account/profile information, usage information, advertising information, and device and network information.

We use your personal information to present you with advertisements. Some of our advertisements may be Behavioral Advertisements . Please see the section “Advertising Choices” below to learn about your choices.
For safety, security, and fraud prevention including to secure our systems, protect our business, and to investigate, prevent, and detect prohibited or illegal activities and other security/technical issues. We use the following categories of personal information for this purpose: personal details, payment details, GoodVybs account/profile information, usage information, advertising information, device and network information, and communications.
To comply with law and enforce the GoodVybs Terms of Use including to satisfy applicable law, regulation, legal process, or governmental request, and to protect against harm to the rights, property or safety of GoodVybs, its users or the public, as required or permitted by law, and to enforce applicable community guidelines. This also includes determining whether a particular device is permitted to use the account consistent with the GoodVybs Terms of Use. We use the following categories of personal information for this purpose: personal details, payment details, GoodVybs account/profile information, usage information, advertising information, device and network information, and communications.
Who We Disclose Personal Information To
We may disclose your personal information to the following parties:

The GoodVybs family of companies: We share your personal information among the GoodVybs family of companies as needed for the following purposes: to provide our service; to administer and operate our business; to research, analyze, and improve our services; to enable Partner integrations and promotions; to send marketing and informational messages; to support advertisements; for safety, security, and fraud prevention; and to comply with law and enforce the GoodVybs Terms of Use.
Service Providers: We use Service Providers to perform services on our behalf or to assist us with the provision of services to you. For example, we use Service Providers to provide communications, security, infrastructure and IT services, game-related services, to personalize and improve our service, and to process payments. We do not authorize them to use or disclose your personal information except in connection with providing their services (which may include maintaining and improving their services). To help maintain the safety and security of our service and users, we and our Service Providers may monitor and record message content (such as text or voice chat functionality) to identify harmful behavior, security risks, and violations of the GoodVybs Terms of Use and community guidelines. Our Service Providers may process your personal information for the following purposes: to provide our service; to administer and operate our business; to research, analyze, and improve our services; to send marketing and informational messages; for safety, security, and fraud prevention; and to comply with law and enforce the GoodVybs Terms of Use.
Partners: If you have a relationship with one or more of our Partners, we may share certain personal information with them in compliance with applicable law. For example, depending on what Partner services you use, we may share personal information so that GoodVybs content and features can be suggested to you in the Partner’s user interface. Partners may process your personal information for the following purposes: to administer and operate our business; to research, analyze, and improve our services; to enable Partner integrations and promotions; and to send marketing and informational messages.
GoodVybs marketing providers: When we market GoodVybs on third party services, some of those services, as well as the marketing Service Providers that we use to purchase, deliver, optimize, or measure our marketing (collectively “GoodVybs Marketing Providers”), may receive information from us (for example, the steps completed in the GoodVybs registration process). Common uses of this type of information are to measure the effectiveness and optimize our marketing campaigns. GoodVybs uses contractual and technical measures designed to prevent GoodVybs Marketing Providers from accessing information regarding specific shows or movie title selections you make, URLs you land on, or shows or movies you have watched on our service. We do not share information about title selections of shows or movies you have watched on our service. GoodVybs Marketing Providers may process your personal information for the following purposes: to research, analyze, and improve our services; and to send marketing and informational messages.
Advertising Companies: We may disclose certain personal information to Advertising Companies (see definition above) in order to select advertisements shown on GoodVybs, to facilitate interaction with advertisements, and to measure and improve effectiveness of advertisements. These companies may process your personal information for the following purposes: to support advertisements.
Promotional collaborations: We may collaborate with third parties for Offers. To fulfill these types of Offers, we and the third parties may use your personal information for the following purposes: to enable Partner integrations and promotions; and to send marketing and informational messages.
Corporate transactions: In connection with a reorganization, restructuring, merger, or sale, or other transfer of assets, we will transfer personal information provided the receiving party agrees to respect your personal information in a manner that is consistent with this Privacy Statement. We may disclose your personal information in such instances for the following purposes: to provide our service; to administer and operate our business; to research, analyze, and improve our services; to enable Partner integrations and promotions; to send marketing and informational messages; to support advertisements; for safety, security, and fraud prevention; and to comply with law and enforce the GoodVybs Terms of Use.
Safety, security and fraud prevention: GoodVybs and its Service Providers may disclose your personal information to third parties where we reasonably believe disclosure is needed for the purpose of: safety, security, and fraud prevention.
Compliance with law and enforcing the GoodVybs Terms of Use: We may disclose your personal information as necessary to comply with applicable law, regulation, legal process, or governmental request, and processing necessary to protect against harm to the rights, property or safety of GoodVybs, its users or the public, as required or permitted by law. We may disclose personal information for the following purpose: to comply with law and enforce the GoodVybs Terms of Use.
International Transfers of Personal Information
GoodVybs operates from various countries around the world, as do its Service Providers, Partners, and other third parties to whom we may need to disclose your personal information, as described above. This means that when you use or interact with GoodVybs, your personal information may be transferred to other countries that have different data protection laws than those where you reside.

However, whenever we transfer personal information to other countries, we ensure that the personal information is transferred in accordance with applicable data protection laws and this Privacy Statement. Specifically, we use a variety of contractual, technical, and organizational measures as appropriate for such transfers, including data protection agreements, technical protections, and practices to challenge disproportionate or unlawful government authority requests. Supplemental Privacy Disclosures
We provide supplemental information regarding certain aspects of the GoodVybs service (such as certain GoodVybs games features) in the section “Supplemental Privacy Disclosures for Certain Services and Regions” below. In addition, data protection laws in certain countries or regions may require us to provide additional or different information to disclosures above in this Privacy Statement. Where this is the case, such information is also provided in the section “Supplemental Privacy Disclosures for Certain Services and Regions” below.

Your Privacy Rights
Access, correct, update, or delete your personal information: You have a right to confirm whether we process your personal information and to access and receive a copy of the personal information we process about you. You may also correct or update out-of-date or inaccurate personal information or request that we delete personal information that we hold about you.

To request a copy of your personal information, please visit your profile or contact us via our contact form. In addition, under the “Account” section of our website, you can access and update information about your account, including your contact information, payment information, and various related information about your account. You must be logged in to access the “Account” section.

Portability and downloading a copy of your personal information: You can request portability of or download a copy of your personal information. To download a copy of your personal information go to our contact for and inform us you would like a copy.
Objection, restriction, and withdrawal of consent: You can object to or request that we restrict processing of your personal information. If we have collected and are processing your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent. 
Right to complain: You have the right to complain to a data protection authority about our processing of your personal information but we encourage you to first contact us with any questions or concerns.
Right not to be subject to automated decision making: You may have a right not to be subject to a decision made solely using automated means, where such decision would have a legal effect on you or produce a similarly significant effect.

You can exercise the rights described above when we receive a verified request in accordance with applicable law.

Communication and Marketing Preferences
Email and Text Messages. If you no longer want to receive certain communications from us via email or text message, please access the “Notification settings” option for the relevant profile within the “Account” section of our website. Alternatively, click the “unsubscribe” link in the email or reply STOP (or as otherwise instructed) to the text message (note: you may receive a confirmation text message in this case). Please note that you cannot unsubscribe from transactional messages from us, such as messages relating to your account transactions. If you consent to receive GoodVybs communications on your phone number such as through text messages, we do not disclose your phone number or your consent to third parties (or affiliates) for their own promotional or direct marketing purposes.
Push Notifications. You can choose to receive mobile push notifications from GoodVybs. GoodVybs will send you push notifications from time to time in accordance with any notification preferences you have set on your mobile device. If you later decide you no longer want to receive these notifications, you can use your mobile device’s settings to turn them off (or via the “Notification settings” described in the preceding section). Please note that individual GoodVybs games may have their own push notifications (you can use your mobile device’s settings functionality to turn them off). We also offer push notifications on certain web browsers. If you agree to receive those notifications and later decide you no longer want to receive them, you can use your browser’s settings to turn them off.
Matched Identifier Communications from GoodVybs. Some third party services allow us to reach users with online marketing about GoodVybs content or the GoodVybs service by sending privacy protective contact information to the third party. Privacy protective contact information means we use pseudonymization technologies (such as hashing) to convert the original contact information (such as an email address or phone number) into a value (typically a long alphanumeric sequence of characters) that cannot, by itself, reveal your identity or contact information. The third party compares GoodVybs’ privacy protective contact information with privacy protective contact information in its own database and there will be a match only if you have used the same contact information with both GoodVybs and the third party. If there is a match, GoodVybs can then choose whether or not to send GoodVybs marketing to you on that third party service, and can optimize and better measure the effectiveness of such marketing. You can indicate your choices regarding the Matched Identifier Communications on third party services in the “Privacy and data settings” (for the relevant profile) within the “Account” section of our website.
Marketing of the GoodVybs service using cookies and similar technologies. To exercise choice around cookies or resettable device IDs collected for marketing of the GoodVybs service or GoodVybs content on third party service, please use the tools described in the “Cookies and other Technologies” section below.
Advertising Choices
Behavioral Advertising Choices for Advertisements on GoodVybs

We respect your Behavioral Advertising preferences, as applicable. If you are eligible for Behavioral Advertisements, a “Behavioral Advertising” setting will be available to you in the “Privacy and data settings” menu (for the relevant profile) of the “Account” section of our website that you can adjust at any time.

If your Behavioral Advertisements setting is off, you will still see advertisements, but they will be non-behavioral advertisements.

An option to opt out is not provided in a Kids profile because we do not engage in Behavioral Advertising on Kids profiles.
Digital Advertising Alliance Opt Out Control

Section C: Access to Account and Profiles
Sharing your account with others: If you share your account with others in your household (see GoodVybs Terms of Use), please ensure that they are aware of and have read this Privacy Statement. This Privacy Statement applies to their use of GoodVybs.

If you share or otherwise allow others to have access to your account, they may be able to see viewing information, account information in the “Account” section of the service, and game related information such as text chat contents and saved game information. This remains true even when you use the profiles feature. Please note that viewing history, recommendations, “continue watching” and similar information may be made available through various features and user experiences, such as Partner interfaces that are integrated with the GoodVybs service.
Profiles: Profiles allow users on a GoodVybs account to have a personalized GoodVybs experience, built around the GoodVybs content of interest to them, as well as separate watch histories. Please note that profiles are available to everyone who uses your GoodVybs account, so that anyone with access to your GoodVybs account can navigate to and use, edit or delete profiles, and information within or associated with the profile. You should explain this to others with access to your account, and if you do not want them to use or change your profile, be sure to let them know. We also have various parental controls available.
Profile Transfers: The profile transfer feature on your account allows you and users with access to your account to transfer an eligible profile from your account to a separate account (including information such as viewing history and recommendations). You can change the setting for this feature in the “Account” section of our website.

Account Login Features: You may have the option to use certain account login features, such as email-based or text message-based login, or easier login to the GoodVybs app on certain devices. Please note that any device that is logged into your account will remain logged in unless you log out of those devices (following the instructions below).
Removing device access to your GoodVybs account: To remove access to your GoodVybs account from devices that are logged into the account, visit the “Account” section of our website, locate the “Sign out of all devices” option, and follow the instructions to sign out of your devices. Users of public or shared devices should log out at the completion of each session. If you sell or return a computer or GoodVybs supported device, be sure to first log out. If you or other users on the account do not maintain the security of your email address, login information, and signed-in devices, or fail to log out a device you sell or return, then others may be able to access your GoodVybs account, including your personal information.
Section D: Cookies and other Technologies
We, our Service Providers, GoodVybs Marketing Providers, and Advertising Companies use cookies, other similar technologies (such as pixel tags), hashed identifiers, and resettable device identifiers for various reasons. This section explains the types of technologies used, what they do, and your corresponding choices. To choose whether or not to receive cookies and similar technologies, please see the section below “How can I exercise choice regarding these technologies?”

Cookies and Similar Technologies, Pixel Tags and other Identifiers
Cookies are small data files that are commonly stored on your device when you access websites and online services. The text in a cookie contains a string of numbers and letters that may uniquely identify a device and can contain other information as well. This allows the web server to recognize your browser each time it connects to that web server.

We use other technologies such as browser storage and plugins (for example, HTML5, IndexedDB, and WebSQL). Like cookies, these other technologies may store small amounts of data on a device. Pixel tags often work in conjunction with cookies. In many cases, declining cookies will impair the effectiveness of pixel tags associated with those cookies.

We may also create, use, and disclose privacy protective identifiers such as hashed identifiers. As described above, hashing is a process of converting the original contact information (such as an email address or phone number) into a value (typically a long alphanumeric sequence of characters) that cannot, by itself, reveal your identity or contact information.

If you use a GoodVybs app (such as the main GoodVybs app, or a GoodVybs game app) on a mobile device, tablet, or streaming media device, we may collect a resettable device identifier from your device. Resettable device identifiers can be used like cookies and are found on many mobile devices and tablets (for example, the “Identifier for Advertisers” on Apple iOS devices and the “Google Advertising ID” on Android devices), and certain streaming media devices.

Why Does GoodVybs Use These Technologies?
We use these types of technologies for various reasons, including to provide our service (for example, by making it easy to access our service by remembering you when you return); to administer and operate our business, to research, analyze and improve our services (for example, to improve site performance, monitor visitor traffic and actions on our site, and to test the effectiveness of our user interface); to send marketing and informational messages (for example, to deliver and tailor our marketing, to understand interactions with our emails, marketing, and marketing on third party services, and to help keep track of items you put into your shopping cart, including when you have abandoned your cart, and to determine when to send cart reminder messages via SMS); to support advertisements; for safety, security and fraud prevention; and to comply with law and enforce the GoodVybs Terms of Use. These technologies enable GoodVybs, GoodVybs Marketing Providers, and Advertising Companies to collect personal information (such as the pages you visit and device and network information) when you use our services, and about your online activities over time across different websites.

Sharing Functionality in our Service
You can use sharing functionality available in our service to disclose your personal information in the following ways:

certain portions of our service may give you options to share information or send invitations to others to interact with the GoodVybs service (such as a game session) by email, text message, and social or other sharing applications, using the clients and apps on your device; and
social plugins and similar technologies that allow you to share information.

We may provide support for the GoodVybs service (such as an online support forum for GoodVybs customer support, or a particular GoodVybs game). Information that you post or make available on such sites and forums are publicly available (unless otherwise noted on the site or forum).

Minors
You must be at least 18 years of age or older (or the age of majority in your country of residence) to subscribe to the GoodVybs service. Individuals under this age may only use the service with the involvement, supervision, and approval of a parent or legal guardian. To assist parents or legal guardians, we have various parental controls available. We also offer a Kids experience (e.g., Kids profile) where we process limited personal information (e.g., a persistent identifier) to provide and improve our services, such as to personalize recommendations for GoodVybs content for children, enforce parental controls, and give parents visibility into how their children use our services. We do not engage in Behavioral Advertising on Kids profiles.

Changes to this Privacy Statement

Device and network information: When you use GoodVybs functionality to connect to a GoodVybs game (such as a “GoodVybs Game on TV”), we collect information about the app, device, and the GoodVybs account (if you are logged in) on which the GoodVybs device is running.

When you play GoodVybs games, we use personal information as described in the GoodVybs Privacy Statement. If you play games with the features mentioned above (or similar features), the following provides additional examples of how we may use your personal information:

To provide our service: When you play GoodVybs games that include these features (or similar features), we use your personal information in order to provide the game including the features, as described below. We use the following categories of personal information used to provide our service with these features: GoodVybs account/profile information, usage information, and device and network information. In particular:
For features such as leaderboards and game achievements, we use your personal information (such as your game handle), in order to display the leaderboard and achievements to you and other players;
For features that enable you to find or interact with other players in GoodVybs games (such as online multiplayer games), we use your personal information and the personal information you provide about others in order to find that player and send them your connection request (and for them to find you and send you a connection request);
For online multiplayer games, we may display the general location of your device (such as your city, state/province, or country), and use that information to match you with other players that are close to the relevant game server so that your gameplay is less likely to be interrupted by internet delays;
For communication features, such as text or voice chat, we transmit communications you send to another player or group of players and deliver communications they send to you. Note that we may use Service Providers to perform services related to these communications on our behalf (as described in the Privacy Statement), which may include providing text or voice chat, moderation, and related services; and
For user-generated content features, we use your personal information to display your user-generated content to other players in the GoodVybs game, or in accordance with how you have shared the user-generated content (for example, on a third party service).
For safety, security, and fraud prevention: When you play GoodVybs games with text or voice chat, or user-generated content features, we use the following categories of personal information for safety, security and fraud prevention including to secure our systems, protect our business, and to investigate, prevent, and detect prohibited or illegal activities and other security/technical issues: personal details, payment details, GoodVybs account/profile information, usage information, advertising information, device and network information, and communications. We and our Service Providers may monitor and/or record text and voice chat during your use of those features (but do not have the obligation to do so) for the preceding reasons, including to enforce the GoodVybs Games Community Guidelines.
Who We Disclose Personal Information To
When you play GoodVybs games, we may disclose personal information as described in the GoodVybs Privacy Statement. If you play games with the features mentioned above (or similar features), the following provides additional examples of how we may disclose your personal information:

Compliance with law and enforcing the GoodVybs Terms of Use: When you play GoodVybs games with communications features (such as text or voice chat), GoodVybs and its Service Providers may access, preserve, and disclose your information in response to legal requests from third parties, including government agencies and civil litigants. We respond to legal requests where we have a good faith belief that we are required by law to respond, or where we have a good faith belief that a response is required by law in that jurisdiction and the request is consistent with internationally recognized standards such as the International Covenant on Civil and Political Rights. We disclose personal information for the following purposes: to comply with law and enforce the GoodVybs Terms of Use.
Other Players
Information such as your game handle, your gameplay, text or voice chat, and user-generated content (including personal information and other information you provide in these features), and your online status may be publicly available to other players when you participate in a GoodVybs game with features such as leaderboards, local multiplayer, online multiplayer, text or voice chat, GoodVybs devices, and user-generated content. Note that some games may allow you to play with players from other (non-GoodVybs) versions of the game, and in that case, this information will be available to those players. Please use good judgment when using text or voice chat and user-generated content functions (note that even if you remove text chat, other messages, or user-generated content, players that have already seen that information may have saved it).

Games on TV and on GoodVybs.com
Some “GoodVybs Games and on GoodVybs.com”  allow you to connect to a game on a GoodVybs member’s account using a GoodVybs app on your device – for example, by scanning a code on their TV so you and the member can play a game together. For some of these games, you may not need to be logged into a GoodVybs account in order to play the game. In that case, some of the disclosures in the Privacy Statement and these GoodVybs Games Supplemental Privacy Disclosures will not apply to you, such as those relating to collection and use of personal details (see definition above), and the sections related to payment details and billing. Information that is collected as part of “GoodVybs Games or GoodVybs.com,” such as usage information, device and network information, communications, and saved games or game activity, may be linked to the GoodVybs account on which the game is running.

Supplemental Privacy Disclosures for US Residents
These disclosures apply to residents of US states that have adopted comprehensive consumer privacy laws that are in effect (collectively “US State Privacy Laws”). These disclosures supplement the Privacy Statement.

Characteristics of protected classifications under state or federal law (“characteristics of protected classifications”) such as date of birth and gender.
Commercial information such as your purchase history and other products purchased or considered.
Internet or other electronic network activity information (“internet activity information”) such as any information about your interactions with GoodVybs, our Service Providers, or Partners, including choices you have made when engaging with interactive titles, your GoodVybs game activity (such as gameplay, game use, saved game information, leaderboard status and availability status on GoodVybs games), or search queries on the GoodVybs service. We receive information provided by Advertising Companies (see definition above) such as information about your likely interests they have collected or inferred from your visits to other websites and apps to support advertisements.
Geolocation data such as your general location based on your IP address (such as your city, state/province, and postal code).
Audio, electronic, visual, thermal (such as but not limited to heatmapping), olfactory or similar information (“audio/visual information”) such as voice recording when you contact our customer support team, and images collected in connection with GoodVybs games that have user-generated content (for example, drawings).
Inferences we may make using the categories of personal information above in the context of the GoodVybs service.

We explain our sources of information in the section “Where We Collect Information From” above. We engage in the sale and sharing and also have sold or shared (as defined under some US State Privacy Laws) the following categories of personal information in the last 12 months:

Categories of personal information “sold”: Our use of identifiers for GoodVybs marketing activities may be considered a “sale” or “sharing” under some US State Privacy Laws (see section “Communications and Marketing Preferences” → “Matched Identifier Communications from GoodVybs”).

Additionally, we use identifiers for marketing activities (such as Behavioral Advertisements promoting the GoodVybs service or GoodVybs content through use of cookies and resettable identifiers) which can be considered a “sale” or “sharing” under some US State Privacy Laws (see section “Communications and Marketing Preferences” → “Marketing of the GoodVybs service using cookies and similar technologies”).

Use of De-Identified Information
We may de-identify personal information in a secure manner when we determine it is appropriate as part of our business operations. We take reasonable measures to maintain and use the information in a de-identified manner. We do not attempt to re-identify such information, except as permitted under applicable law.

Your Privacy Rights
Residents of states that have adopted US State Privacy Laws have certain rights with respect to your personal information.

Right to Know/Access. Do Not Sell or Share My Personal Information. As of the date of this Privacy Statement, we may use certain categories of personal information to support advertisements or engage in Netflix marketing activities. Under some US State Privacy Laws, these activities may be considered “selling” or “sharing”/targeted advertising. If you do not want us to sell or share personal information about you, you can learn how to make applicable choices by sending a “Do Not Sell or Share My Personal Information” via our contact form. Using these choices will not opt you out of the use of previously “sold” (as defined by some US State Privacy Laws) personal information, or stop all Behavioral Advertising.

We do not knowingly sell or share (as defined by some US State Privacy Laws) the personal information of minors under 16 years of age.

Some web browsers and extensions are compatible with Global Privacy Control (GPC), allowing them to communicate your preference to opt out from specific forms of data processing, including any “sale” or “sharing” of personal information. As described above, we do collect sensitive personal information such as your GoodVybs username, password, and payment details, which could be considered types of “sensitive personal information.” However, we use these types of sensitive personal information only for the purpose of providing our service; administering and operating our business; and other permitted purposes as described in the Privacy Statement and not for a purpose which would require offering a choice to limit its use under some US State Privacy Laws.
Authorized Agents. You have the right to exercise the rights described in this section using an authorized agent acting on your behalf. They can submit a request on your behalf via our contact page along with a statement, certifying as may be required, that the agent is authorized to act on your behalf. In order to verify the request, we may ask you to verify your identity and your authorization of the agent to make requests on your behalf. Right to Non Discrimination. You have a right not to be subject to discriminatory treatment for exercising any of your rights described under this section. We will not discriminate against you based on your exercise of any of your rights.

Appeals
If you are a resident of a US state that gives you a right to appeal a decision, you may appeal our decision denying your request. Requests to change our policies or practices are not grounds for appeal. You may request an appeal by contacting us via our contact page. Please provide the US state that you are writing from, accompanied with documentation regarding the decision you are appealing.

Depending on how you interact with the GoodVybs service, we may not be able to respond to certain requests, including, for example, the right to access or delete personal information. Because we only collect limited personal information about individuals without an account, we are unable to verify requests from non-account holders to the standard required by the US State Privacy Laws.

Notice of Financial Incentives
Some GoodVybs plans or subscriptions may be interpreted to fall within the meaning of a “financial incentive” under some US State Privacy Laws.

If you choose such a plan or subscription, you will receive a discount and when you watch shows and movies on GoodVybs, you will be presented advertisements.

If you would like to change your plan or subscription, you can access the “Account” section of our website and select a different plan or subscription. The monthly fee associated with your GoodVybs plan or subscription will likely increase if you do so. We believe the discount for access to GoodVybs service and our use of the categories of personal information described above to present relevant advertisements to you represents a fair exchange to continue to provide users a high quality service at a lower price. When determining the extent of the discount, we consider projected ad revenue generated by all users projected to participate in a plan or subscription with advertisements and the overall revenue required by GoodVybs to operate and innovate its business, produce the GoodVybs content to entertain its users, and make a profit.
